[bismillahnews 31-03-10] The latest reports from hyderabad are very disturbing.Task forces deputed for protecting muslim area’s from rioters are entering muslim houses and arresting youths.[Hyderabad police biased against Muslims: Owaisi].A very systematic onslaught on muslim businesses and property is continuing from last three days.  We hope normalcy returns to the violence-hit areas in the Old City and beyond, after three days of looting and arson. Due to large measure to the one sided curfew imposed in 25 police station muslim have been cornered by state police and para-military forces by declaring their areas disturbed and curfew imposed [Hyderabad: Old city, walled city, wired city].While Sangh Parivar and their armed organisations are freely looting and destroying muslim property and their honour [MIM warns state against harassment].In the name sake Govt. is doing everything to control the situation but reality is otherwise.Food and water shortage has begun.Board examinations have been postponed.I in my 25 years of jounalistic career I have reported major riots from Uttarpradesh,Bihar,MP. MS,Rajasthan.AP. and almost from all over India.During those times we had limited means but Radio News in muslim colonies kept us informed. Urdu Newspapers were so quick to report such communal disturbances that every every goverment feared them. Today from last three days Non Stop Anti-Muslim Riot and Psychological Muslim Massacare is in progress that too in a Cyber city Hyderabad and we are helpless.We do not have presence in english media,we do not have one National Tv Channel which can present what happens with muslims in such state sponsored riots.Ah the so called National Press is under self imposed emergency when it comes to speak and write against such fascist measures of the state.Gujrat was past when no one attented to Ahsan Jafri’s calls.Today I spoke to Barrister Asaduddin Owaisi president AIMIM and Hyderabad’s Member of parliament who was in paris when riots started he is back in Hyderabad.He was in crowd,his voice on phone was disturbing for me as I have known him for years.But his resolve to stand to fight Sangh Parivar by every constitutional means was firm.He earnestly wanted all of us to do whatever we can from where ever we are in what ever numbers.We outside Hyderabad should show to the world that we stand with those fighting the bullets of state and rioters of sangh parivar. The rise of Muslim power at National level through AIMIM and its President Barrister Assaduddin Owaisi has created fear among all political parties that the day is not far when his Platform will be a challenge for 7 race course road, hence we see well planned uppercaste conspiracy of riots to restrict him to Hyderabad ONLY, a party with one M.P. But in these troubled times Barrister Asaduddin Owaisi and MIM [Owaisi breaks curfew, creates ruckus at PS] by relief efforts both material and legal to the victims have once again proved to the Nation and World the stealth they are made of in the way of serving people.Expect fire craker in the parliament on resumption. *An Open Letter to Sonia Gandhi*

*May I draw your kind attention to the fact or fiction that more and more
people are coming out with the realisation that ‘communal riot’ in
**India**is the HALL MARK of Congress party administration.

*It is sad that while Gujarat’s BJP Chief Minister Narendra Modi has been
summoned by SIT under the direction of India’s highest judicial body, the
Supreme Court of India, a signal should have gone out to all in political
and administrative circles all over India that a season of reckoning has at
last dawned on India, and those who had taken law into their own hands will
truly face a day of judgment, eventually. *

*It cannot be called coincidence if old cases, on L. K. Advani, Narendra
Modi and Sajjan Kumar are revived. *

* *

*However, the way Congress ruled state of Andhra has once again witnessed a
‘communal riot’ with Hindu mobs carrying long batons (lathis) and attacking
unarmed Muslims in the old city of Hyderabad, the scourge of communal riot
once again raising its ugly head, cannot be called a sudden conflagration. *

*The time that the Hindu mob availed to collect with lathis should have been
enough for the local police to spring into action instantly. A prior search
should have been conducted for lathis and other arms, if state intelligence
had been faithful to its duties. The fact that both intelligence and police
failed and let the riot spread out, points to the possibility that political
consideration prevailed in this law and order situation. *

March 25: In a major victory to the Andhra Pradesh government, the Supreme Court on Thursday permitted it to continue with four per cent reservation for 14 backward groups among Muslims for the time being.

While revoking the Andhra Pradesh High Court’s stay on the quota, the bench consisting of Chief Justice K.G. Balakrishnan and Justices J.M. Panchal and B.S. Chauhan referred the case to a Constitution bench that will assemble in second week of August to take up the matter.

At the same time, the bench restrained the government from extending quotas to other unidentified groups of the Muslim community. The interim order came on a special leave petition filed by the AP government challenging the ruling of a seven-judge bench of the High Court that had quashed the Andhra Pradesh Reservation for Socially and Educationally Backward Classes of Muslims Act, 2007, as being unconstitutional on the ground that reservation cannot be extended on the basis of religion.

The SC bench, before issuing the interim order, grilled lawyers who appeared for the anti-reservationists and asked them what was wrong in taking affirmative action for uplift of the socially and educationally backward groups in the Muslim community when such groups among Hindus were getting the benefit of quotas.

“The state government is of the view that certain sections of Muslims are socially and educationally backward,” said the Chief Justice. “What is wrong in providing the benefit? It is only a question how you identify them.”

“Merely because they are Muslims, they can’t be denied of it,” he added. “The social and educational backward classes (among them) are identified (by the state). For how many years they will be deprived of it?”

The bench repeatedly pointed out that the reservation is not provided to the entire Muslim community but only to some groups. The senior advocate, Mr Harish Salve, appearing for those opposing the quota, said there was nothing wrong in taking “affirmative” action for uplift of backwards among the Muslims but questioned the manner in which the state government had tried to do it.

“It is nothing but religious reservation given in the disguise of social and educational backwardness,” he argued. Mr Salve cautioned that extending “religion-centric” reservations posed a grave “danger of fissiparous tendencies developing in the country.”

Earlier, the Attorney General (AG), Mr G.E. Vahanvati and the Andhra Pradesh’s counsel, Mr K. Parasaran, defended the state’s law, saying that it was brought after identification of the 14 backward groups among the Muslims. Mr Parasaran pointed out that while barbers, dhobis and those working in cremation grounds in the Hindu community were extended reservation benefits, similarly placed groups in the Muslim community were deprived of the benefits.

Mr Vahanvati also referred to Sachar committee and Ranganath Mishra commission reports, which had favoured “affirmative” action for uplift of Muslims. He also argued that the High Court failed to consider the fact that identification of the most backward groups among the Muslims was done by the Andhra Pradesh Commission for Backward Classes.

“Exclusion of better off groups such as Syed, Mushaik, Mughal, Pathan, Irani and Arab and several others shows that the reservation is not based on religion,” the AG said. In its appeal against the High Court verdict, the AP government had said that there were about 24 Muslim groups in Andhra Pradesh of which 14 listed in the schedule were the most backward and needed affirmative action.

Muslim quotas hit legal hurdle again

    HYDERABAD: The State Government’s bid to provide reservations to  Muslims have been beset by snags ever since the late YS Rajasekhara Reddy envisaged them on coming to power in 2004.

It is for the third time that the High Court has quashed the proposed quotas.

As soon as he became chief minister, Rajasekhara Reddy had an executive order issued providing 5 per cent reservations to Muslims. But, in November 2005, the High Court quashed the order as unconstitutional and arbitrary.

When the State went in for appeal, the Supreme Court, in January 2006, refused to grant stay on the High Court order.

The same year, a legislation was brought forth providing 5 per cent reservations but this too was also struck down on the grounds that reservations could not be provided on the basis of religion.

The government, however, on the advice of the High Court, reconstituted the backward classes commission and entrusted it with the responsibility of undertaking a thorough survey of the socio-economic conditions of the Muslims.

On 4 July 2007, the State Cabinet approved the BC Commission’s report and based on this scaled down the quota from 5 percent to 4 with a view to averting further legal hurdles.

On July 7, the then governor Rameshwar Thakur issued an ordinance to this effect. On July 23, the AP Reservation (in Favour of Socially and Educationally Backward Classes of Muslims) Bill was passed in the Assembly replacing the ordinance.

Understandably, the Bharatiya Janata Party (BJP), opposed the move to create reservations on the basis of religion.

Its Floor Leader G Kishan Reddy described the bill as unconstitutional and voiced the fear that it might portend “danger to national integrity’’.

He staged a walkout from the Assembly.

The bill excluded the creamy layer among the Muslims — that is, those who with an annual income of over Rs 4 lakh were not eligible to avail themselves of the benefit.

The then minister for Minorities Welfare, Mohammad Ali Shabbir, in his reply to the debate on the issue in the Assembly, said the new reservations would be available to 15 groups identified by the AP Backward Classes Commission as socially and educationally backward. For the purpose of extension of reservations to Muslims, a new group, E, was created in the Backward Classes list.

By reducing the quota to four per cent, the total reservations in the State averted the 50 per cent ceiling imposed by the Supreme Court and by categorising the Muslim Community into 15 backward groups, the reservation facility was to appear as if it was being given on a socio-economic rather than a religious basis.

After the act was passed, it was again challenged in the Hgih Court. The petitioners had contended that the government had identified Backward Classes among Muslims without the support of sufficient data. When the High Court allowed admissions made under the quota, the petitioners approached the Supreme Court which stayed implementation of the order but left it to the High Court to dispose of the petitions.

BC reservation seems jinxed with the government.

This is the third time that the High Court has struck down the government action. The entire legal dispute has seen two chief ministers, three chief justices and three advocates-general.

In the earlier round the matter was heard by Chief Justice (acting) Bilal Nazki then Chief Justice Singhvi and finally Chief Justice AR Dave.

Three Advocates-General have been called upon to defend the quota. They were D.Sudarshan Reddy, CV Mohan Reddy and DV Sitaram Murthy. One constant face for the government is present Additional Advocate- General Satya Prasad.

In the present round, even the admissions of the writ petitions faced technical hiccups. The matter was first posted before Chief Justice Singhvi and Justice CV Nagarjuna Reddy. Justice Reddy recused himself.

It was then posted before Chief Justice Singhvi and Justice Seethapathy. Then Justice Seethapathy recused.

The matter then came up before the Chief Justice and Justice Nooty Rammohan Rao. Justice Nooty Rammohan Rao recused. The matter was then admitted by Chief Justice Singhvi and Justice B Prakash Rao.

Conspicuous by his absence was advocate Sriram Subrahmanyam who had played an active role in the many rounds of hearing of the litigation but was not available to receive judgement for petitioners as he is now with the government as a special government pleader.

Justice Varma crated a record of sorts in not delivering his judgement and only announcing his verdict.

Hyderabad, December 22: Muslims in the Telangana region today appealed to the Union Government to speed up formation of Telangana State, and urged the State Government to withdraw a l l cases registered against students and Telangana sympathisers who participated in the movement and release them at the earliest.

Muslim Forum for Telangana convener Lateef Mohd Khan alleged that Muslims were the worstaffected in united Andhra Pradesh in respect of culture, tradition and Urdu language. “The representation of Muslims in political and developmental aspects was restricted in the name of minority.

More number of Muslims will get an opportunity to participate in the development of Telangana state,’’ he said.
